Warren Mouck: Warren is an associate with Cheadles specializing in the areas of labour and employment law, administrative law and litigation. Warren regularly advises clients on a range of employee and labour relations issues, and is a member of the Northwestern Ontario Chapter of the Human Resources Professionals Association. In addition to his JD, Warren holds a BA in Criminology and a Graduate Certificate in Human Resource Management.

Vicky Kraft:     Vicki (Victoria) Kraft is a senior counsel in the Legal Counsel Division of the City of Chicago Department of Law, where she has worked since 1999. A former college professor, Ms. Kraft received her B.A. and M.A. degrees in Political Science from Northern Illinois University, and her J.D. degree and Ph.D. degree in Political Science from the State University of New York at Buffalo. Admitted to the bar in New York and in Illinois, Dr. Kraft is the author of The United States Constitution and Foreign Policy: Terminating the Taiwan Treaty (Westport: Greenwood Press, 1991), and is a past president of the New York State Political Science Association (1996-1997).

CONDO CASES FROM ACROSS CANADA

Sonja Hodis LLB:     Sonja is a litigation lawyer based in Barrie that practices condominium law in Ontario. She advises condominium boards and owners on their rights and responsibilities under the Condominium Act, 1998 and other legislation that affects condominiums such as the Human Rights Code. She represents her clients at all levels of court, various Tribunals and in mediation/arbitration proceedings. Sonja has also gained recognition for creativity and tenacity in ground breaking human right case law, in the condominium industry.

Jamie Herle:     Jamie is an owner with WMCZ Lawyers in Saskatoon, Saskatchewan. She has been practicing condominium law for over 10 years. Jamie works with both developer's, condominium boards and owners in her daily practice. Jamie is frequently consulted on and asked to present on condominium issues. She was involved with the Saskatchewan Justice review of the Condominium Property Act, 1993 in Saskatchewan. Jamie has been involved with CCI both locally and nationally for 12 years. She started as a board member with CCI-South Saskatchewan, and in 2014 she joined the National Executive Board.

Devon E. Cassidy, BSC, LLB, LLM:     Devon completed her Bachelors of Law at the University of the West of England, Bristol Law School and her Masters of Law at Trinity College Dublin focusing on International Business Law. She is an an Associate Lawyer with the law firm, Cassidy Nearing Berryman located in Halifax, Nova Scotia. Her practice focus is Condominiums, Real Estate, Estates and Family Law. She lectures in the area of Real Estate at Dalhousie University's Schulich School of Law. Devon has been a Board Member of the Nova Scotia CCI Chapter since 2013 and is the current President of the Chapter.

BILL 106 - ONTARIO CONDOMINIUM ACT UPDATE

Doug Shanks:     Mr. Shanks is a senior partner at Cheadles LLP in Thunder Bay, Ontario. Mr. Shanks practices in the field of business law, including condominiums. Prior to entering law school Mr. Shanks completed two years of undergraduate study in sciences, economics and business. He was called to the Bar in 1978. Mr. Shanks has taught corporate law in Thunder Bay at the Bar Admission Course for the Law Society of Upper Canada. He is a former lecturer and guest lecturer in business law at the Faculty of Business, Lakehead University, Thunder Bay, Ontario. He is also a past director of the Thunder Bay Law Association, past member of the Canadian Tax Foundation and past member of the Canadian Bar Association, Ontario Council.

Armand heads up the condominium law department of law firm of Shibley Righton LLP and represents numerous condominium corporations across Ontario. Armand resides in Toronto, is a Past-President of the Canadian Condominium Institute (Toronto), where he also serves on the Board of Directors and is Chair of the Legislative Committee which has completed and submitted an extensive legislative brief to the Ontario government with recommendations for changes to the Condominium Act, 1998 (the "Act"). Armand has been on all the government committees involved in the reform of the Act and was one of 11 people appointed to the government's Expert Panel that conducted the final analysis of the Act. Armand has also been appointed as on the four Founding/First Directors of the newly Created Condominium Authority of Ontario.

Armand resides in Toronto, is a Past-President of the Canadian Condominium Institute (Toronto), where he also serves on the Board of Directors and is Chair of the Legislative Committee which has completed and submitted an extensive legislative brief to the Ontario government with recommendations for changes to the Condominium Act, 1998. Armand is also the Co-Chair of the joint ACMO and CCI (Toronto) Government Relations Committee and a member of CCI National's Government Relations Committee and he assembled the 2nd Edition of the CCI National publication "Canadian Condominium Legislation – A Coast to Coast Comparison", which is a comparison of condominium legislation from every jurisdiction across Canada. In addition, Armand is a member of the Discipline Committee for the Association of Condominium Managers of Ontario ("ACMO").

Armand has written articles for such publications as ACMO's "CM Condominium MANAGER", CCI (Toronto)'s "theCondoVoice", "Humber Happenings", the "Condominium Law Letter", "Canadian Real Estate" and the "Real Estate News". He has also lectured before the ACMO, CCI's Directors' courses, and at Humber College on various aspects of condominium law, along with presenting at various condominium conferences, including the Annual ACMO/CCI-T

Conference and the Toronto Condo Show and has appeared on television shows to discuss condominiums.

Armand also is the first lawyer in Ontario to be a court appointed full Administrator (appointed under the Condominium Act, 1998), to take over all the duties of a Board of Directors of, and run, troubled corporations

From time to time, corporations need to repair or replace major components of the common elements. Financing of such large projects is an important matter. This seminar addresses financing from the prospective of the Condominium Act, external financiers and managers aspects.

This course will earn RECO or RIBO attendees MCE credits for 3 hours of instruction. RECO and RIBO attendees will need to provide their Registration Number, check in & out to comply with requirements.

If you did not attend Sessions I &/or II, it is recommended but not required that you preapre for Session III by reading chapters 1 to 12 in the binder (however, there will be a very brief review of Sessions I & II covering chapters 1 through 12.) This is an excellent way for Board members to demonstrate their due diligence and will provide you with an understanding of Reserve Funds, Investments, Audits, and Taxes.

Two lawyers who have dealt with a number of condominium cases and a knowledgeable insurance adjuster will provide a panel discussion. They will also review decisions of the Courts and issues that have arisen in their practices dealing with topics of interest to condo unit owners, Condomium Corporations and the purchser of condominium units. There will be plenty of time for questions and answers after the panel presentation.

The seminar is to give directors, managers and owenrs insight into legal matters faced by other Condominium Corporations, and the reason why the case was won or lost. This is essential information for everyone that owns a condo.


LEVEL 100 - THE CONDOMINIUM COURSE
